It has pedals, it’s capped at 26 mph and it has a throttle - how is it not, legally, a Class 3 e-bike with all the rights that implies?

It would be a moped in Finland at least, where mopeds are up to 45kmh (28mph)

Nah, Class 2 top speed is 20 mph. If it goes over 20 but not 29+, it’s Class 3.
