Duh its a bad faith argument.
Its a recent law that has only been on the books for checks notes 50 years.
Fox is “entertainment”, not news.
Then every news outlet should label themselves as such to avoid these FCC threats.
Most have. However, broadcast tv has an obligation to have news, so they don’t or they would be in breach of licence conditions.
They are entertainment. They spent hundreds of millions to maintain that status in court a long time ago.
